EXUS Legal Recoveries is a component of the EFS Loan Collections Software, the debt collections suite that manages credit risk along the whole lifecycle of accounts. It is fully integrated with all other components of the EFS Loan Collections Software but it can also be integrated with 3rd party solutions.
EXUS Legal Recoveries supports all operations that take place after collections have failed, either through in-house management or outsourcing to external associates such as bailiffs, law firms, etc. It supports configurable legal processes to facilitate the needs of customers operating under different legal environments and has successfully been deployed in several countries. It provides end users with visual business process design tools, supports generation & attaching of legal documents, management of payment arrangements, handling of recoveries, collaterals & asset tracking, as well as handling of 3rd party expenses, fees and invoices.
EXUS Legal Recoveries supports the definition of legal processes, referring to the actual execution of litigation actions on legal file. Each legal process has an associated set of statuses which is defined per legal process type. Depending on the actions registered by legal officers, these statuses and their associated legal processes are affected in real time. Even though legal processes differ from country to country, EXUS Legal Recoveries allows for the full configuration of an unlimited number of processes and their associated statuses for monitoring typical processes such as Court Permissions, Court Appeals, Investigations, Asset Executions (auctions), etc. and customs processes per country.
And all this, performed by end users without the need for intervention by the IT.
Through its Alerts mechanism, EXUS Legal Recoveries notifies users for upcoming proceedings (e.g. court proceedings), upcoming mandatory actions that need to take place or any kind of reminder action that has been scheduled by the user.
EXUS Legal Recoveries supports the registration and management of expenses that incur while performing litigation actions. Expenses refer to any kind of fee paid to a 3rd party, such as law offices/external agencies, taxes and other expenses paid to state authorities, or any other expense incurred during recovery.
It supports an unlimited number of types of expenses, managed by end users, such as “Asset Evaluation Fee”, “Court Appeal Fee”, “Travel Expense”, etc. Expenses may be registered through direct data entry from external associates – if the organisation has opted to provide its external associates (e.g. executors, bailiffs, etc.) with access to the system -, batch loading of expense files submitted by external associates, or even direct entry from a proxy (“on behalf” mode).
EXUS Legal Recoveries also manages the invoices relating to registered fees/ expenses. Invoices may be registered in the system through multiple ways, while validation rules may be applied during registration to avoid common errors. Invoices may follow an approval process, defined by end users, while approved invoices may be “pushed” to the bank’s accounting system for further processing.
EXUS Legal Recoveries supports asset/collateral management by providing users with up to date, detailed information related to movable or immovable assets, either linked to accounts as collaterals or identified through asset investigation processes. For every asset, either registered through user input or received through integration with back office systems, a rich set of information is available, including asset details, offers, evaluations, etc.
EXUS Legal Recoveries provides end users with a template designer tool to design and maintain any kind of legal document template required, used both for massive or ad-hoc production. In addition, EXUS Legal Recoveries offers the ability to attach documents, either scanned or produced by the EFS Loan Collections Software, in the customer legal file or in any particular account of the customer.
Throughout the execution of legal processes, EXUS Legal Recoveries supports the set-up and monitoring of payment arrangements, as well as the registration of recoveries. The system may propose payment arrangements in accordance with the organisation’s policy, while authorized end users may be allowed to alter it using the specialized “settlement calculator”, which supports multiple settlements schemes, interest rates, etc.
